The purpose of this DISCLAIMER AND NOTICE is to make you aware of the potential risks connected with roller skating and to help you make an informed decision as to whether or not you should participate in these types of activities.
By booking or attending a class or course with us you agree to the terms in our health and safety waiver disclaimer.
At your first class our coaches will ask you to disclose any medical conditions; physical and mental, injuries, allergies, and medication you are taking that may affect your participation in a roller skating class. Please give honest accounts so that they can make alternative suggestions - we may be able to tailor the class to your needs. Please note our coaches are not trained to give you health or medical advice.
DISCLAIMER OF LIABILITY
Roller skating is a fun activity but injuries of all types can occur when participating in roller skating, hence Roll Happy strongly encourages all members/ participants to obtain a comprehensive physical examination by a licensed physician PRIOR to undertaking any exercise or training demonstrated at classes/ workshops/ events, and/or any of the videos, MP3s and training manuals offered, you fully assume the risk of any resulting injury.
Such injuries include but are not limited to:
Bruising, cuts and general soreness
Muscle and tendon injuries
Ligament and skeletal injuries
Fractured or broken bones
Roll Happy disclaims any liability for incidental or consequential damages and assumes no liability or responsibility for any loss, injury or damage suffered by any person as a result of the use or misuse of any information provided.
Pre-Existing Medical Conditions:
We highly recommend that you do not take part in an exercise activity if you suffer from high blood pressure, heart, back or neck problems, brittle bones, joint injuries or any other condition that could be aggravated by this activity or if you are pregnant/post natal. If you are, or suspect you are pregnant/postnatal you should not take part in this activity.
In consideration of performing or participating in these types of activities, you hereby agree to indemnify and hold harmless Roll Happy against any loss, liability, damage, cause of action, cost, or expense of any nature whatsoever, including without limitation reasonable lawyers’ fees and other legal costs. Roll Happy reserves the right to refuse admission and to remove persons from the venue/ class/ workshop for any reason including behaviour likely to cause damage, injury, nuisance or annoyance, or for failure to comply with the reasonable requests of our coaches.
SKATING WITH Roll Happy - LIABILITY WAIVER
Roll Happy highly recommends the use of personal protective equipment during skating activity. Wearing protective equipment will greatly reduce the chance of injury due to a fall / collision. Roll Happy accepts no responsibility for injury caused by a fall / collision which would have otherwise not occurred if protective equipment had been worn. Persons using their own skates and equipment are responsible for the maintenance and upkeep of such and Roll Happy cannot be held responsible for any accidents, damage or injury caused by such skates and equipment to yourself or a third party.
People skating at this (various) venue/s do so entirely at their own risk and Roll Happy cannot be held responsible for any accidents caused by in house structures, objects, or by actions of other skaters or the public. Roll Happy is not responsible for any loss, injury or damage, however caused, to yourself or third party, your property or clothing. Anyone deemed to be a danger to themselves or others as a result of excessive alcohol consumption or illegal substance will be refused access to the venue/lesson and surrounding areas and no refunds will be offered.
All information you give to us will be kept in confidence. Your personal details and medical information will not be made available to third parties unless permission to do so is granted by you.
